By accessing and using this website, it's databases at www.RealEstateNorthShore.com (collectively the "Site"), and any site services, you, the user, agree to be bound by all of the Terms of Use and agree to comply with and be bound by the following terms and conditions (the "Terms of Use"), and that these terms constitute a binding contract between you, the user, and Rossetti Realty Ltd..
Rossetti Realty Ltd. reserves the right to change or modify these Terms of Use or any policy or guideline of the Site, at any time and in its sole discretion. Any changes or modification will be effective immediately upon posting of the revisions to the Site, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use of the Site following the posting of changes or modifications will confirm your acceptance of such changes or modifications. Please review these terms and conditions periodically and check the version date for changes.

Rossetti Realty Ltd. provides you with access to this Site and the services offered by RealEstateNorthShore.com available on it, or other Web sites as indicated below (collectively, the "Services"). Access to and use of the Services is governed by these Terms of Use.
Services
The Services include the Rossetti Realty Ltd. Site and other content, products and/or services available on the Site and its affiliates including but not limited to: An Account (The term “Account” refers to a private section of the databases at www.RealEstateNorthShore.com), MLS® listing searches, automatic search alerts, email subscriptions, & market statistics. The Services may also be located on third party Web sites and/or applications either as a link from an add-on service to, or otherwise in connection with, Web sites and/or applications that such third parties control. Nothing contained in any of the Services is an offer or promise to sell a specific product for a specific price, nor does the use of the Services create a designated agency relationship between you and Rossetti Realty Ltd. (see Representation in Trading Services).

BY CONTINUING TO USE THE SITE, you confirm you understand: the special legal duties owed to clients, the differences between a client and an unrepresented party, and the risks of dealing with real estate professional as an unrepresented party. Until such time as an agency relationship is offered to you by Rossetti Realty Ltd., you are an unrepresented party.
If you contact us through the site, a real estate professional with Rossetti Realty Ltd. may ask you to sign the above mentioned forms. You are not required to provide your name or signature on these forms, however we may ask you to do so to document that they were provided as required by the Real Estate Services Act (the “Rules).
This real estate professional will provide a copy of these forms (including any personal information you have provided such as your name or signature) to Rossetti Realty Ltd. (our brokerage). The Real Estate Council of BC, the provincial body responsible for regulating real estate professionals, may review these form for the purpose of monitoring compliance with the Rules.

Account Holder Terms of Use
The term “Account” refers to a private section of the databases at www.RealEstateNorthShore.com (collectively the "Site") through which Rossetti Realty Ltd. provides real estate brokerage services to “Account Holders” (clients and prospects) with whom Rossetti Realty Ltd. has first established a relationship allowing the Account Holder the opportunity to search non-public MLS® data; subject to Rossetti Realty Ltd. oversight, supervision and accountability.
By agreeing to these "Terms and Conditions of Use", I (the Account Holder):
Acknowledge receipt of, and have read and understand the documents published by the Real Estate Council of British Columbia and the British Columbia Real Estate Association entitled “Disclosure of Representation in Trading Services” , “Disclosure of Risks to Unrepresented Parties”, and "Privacy Notice and Consent";
Acknowledge and understand that the Terms and Conditions of Use do not create an agency relationship and do not impose a financial obligation on the Account Holder or create any representation agreement between the Account Holder and Rossetti Realty Ltd.;
Acknowledge and understand the risks of dealing with a real estate professional as an unrepresented party;
Understand that all data obtained from the Site is intended only for your personal, non-commercial use;
Do have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the Account;
Agree not to copy, redistribute or retransmit any of the data or information provided;
Acknowledge the Board/Association ownership of and the validity of the copyright in the MLS® database;
Agree that all information provided may be provided to the relevant Board and may be used to administer and operate my Account and to investigate any breach of security of the data or the MLS® rules;
Must provide a valid phone number and email address, and will only be permitted access to non-public MLS® data after verifying my Account by confirming that the email address provided is valid and the Terms of Use is confirmed;
Agree to supply a password and understand that my password must be reset every 30 days before being permitted to log back into my Account;
Understand that information on this site is deemed to be valid but is not guaranteed. It is the responsibility of Account Holders to confirm all information on their own. The Listing Brokerages may not have reviewed or approved listing enhancements. All information provided by the Listing Agent/Broker is deemed reliable but is not guaranteed and should not be relied upon without independent verification;
Understand any agreement entered into at any time between Rossetti Realty Ltd. and an Account Holder imposing a financial obligation on the Account Holder or creating agency representation of the Account Holder by Rossetti Realty Ltd. must be established separately from the Terms and Conditions of Use, must be prominently labelled and may not be accepted solely by mouse click;
Agree that a "mouse click" is sufficient acknowledgement & acceptance to the Terms and Conditions of Use.
Modification Of Services
Rossetti Realty Ltd. retains the right at any time to discontinue, modify, or temporarily or permanently terminate the Site with or without notifying you. If we discontinue, modify or terminate the Site in whole or in part, we will not be liable to you or any third party for such discontinuance, modification or termination.
Links To Other Sites
The Site and Services contain links to third-party Web sites. These third-party sites are not under the control of Rossetti Realty Ltd.. We are providing these links to you only as a convenience, and the inclusion of any link does not imply affiliation, endorsement, or adoption by us of the site or any information contained therein. Rossetti Realty Ltd. is not responsible or liable for the contents of any linked site. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any of these third parties. When leaving this Site, you should be aware that our terms and policies no longer govern, and, therefore, you should review the applicable terms and policies, including privacy and data gathering practices, of that site.

No Assignment
You are not permitted to assign your rights and obligations under these Terms of Use.
Interpretation
These Terms of Use shall be interpreted without regard to which party drafted these Terms of Use.
Liability Disclaimer

You agree to indemnify, defend and hold harmless Rossetti Realty Ltd. from any liability, loss, claim and expense (including attorneys' reasonable fees) related to your violation of this agreement.
Choice Of Law, Waiver
These Terms of Use shall be governed by the laws of the Province of British Columbia without regard to its conflict of law provisions. Rossetti Realty Ltd.’s failure to exercise or enforce any right or provision of the Terms of Use will not be deemed to be a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms of Use remain in full force and effect.
